Inside Wall Street’s Guess the Index Game (the “Game”) is sponsored by Inside Wall Street (“Sponsor”). Weekly Prizes are furnished by Inside Wall Street and various prize suppliers (each a “Weekly Prize Supplier”). The geographic scope of this Game is the United States.
Game is subject to all federal, state and local laws. Void where prohibited by law. By entering, entrants agree to these Official Rules. Limit one (1) prize per household during each weekly game. “Household” includes all persons residing together in a single residence, whether or not related.
Game begins on February 18, 2011 at 12:01 a.m. Eastern Time (“ET”), and ends on March 17, 2011 at 11:59 p.m. ET. Game consists of four (4 separate Weekly Games. Each Weekly Game begins at 12:01 a.m. ET on the last trading day for the stock market during the prior Week(Usually Friday). The deadline for each Weekly Game is 11:59 p.m. ET on the day before the last trading day for the stock market that Week(Usually Thursday). Sponsor’s computer is the official time-keeping device for this Game. Guesses will not rollover to the following weekly game. To qualify for each weekly prize you must submit a guess for that weekly game. The act of a user submitting their guess during each weekly promotion is the equivalent of registering their user account to be in the running for that weekly prize. Each winner will also have the opportunity to win additional cash prizes by inviting three people that are not currently registered with Geuss The Index and having them sign up.
The Game is provided purely as a form of entertainment and is not intended to constitute or offer investment or financial advice of any kind.

ELIGIBILITY

As of the time of initial User Account registration (see below), all entrants must be legal residents of the United States and at least 18 years old or older, or the age of majority in their states of residence, if such age of majority is greater than 18.
Employees of Inside Wall Street, any Weekly Prize Suppliers and the members of their immediate families (defined as spouse, parents, siblings or children) and households (whether or not related), are not eligible to enter or win. For identification of the Weekly Prize Supplier, visit the Contest website at www.guesstheindex.com.
If a contestant is declared a winner of one of the weekly games that contestant will not be eligible to win the following week. No contestant will be allowed to win two weekly games in a row.

PRIZES

Weekly Prize of one hundred dollars ($100.00) cash will be redeemable by the winner of each weekly game.
The weekly winner of the Guess The index Game will also have the opportunity to win an additional one hundred dollars ($100.00) if they invite three or more (3+)people that result in a minimum of three sign ups on the week that the registered user wins the guess the index challenge.
The odds of winning depend on the number of entries received for each weekly game promotion.
To qualify for the bonus prize, contestants must submit their invitations through our website.

PRIZE RESTRICTIONS

All details of all prizes shall be at Sponsor’s sole discretion. Winners assume sole responsibility for all costs associated with the prizes not explicitly outlined above, including without limitation, all federal, state and local taxes (if any).
Prizes are not redeemable for cash and may not be sold, bartered or auctioned. Prizes may not be transferred or substituted except that Sponsor in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.
Any portion of any prize not used or accepted by any winner is forfeit and no cash substitute will be offered or permitted. All prizes being offered are provided “as is” with no warranty or guarantee either express or implied by Sponsor. Merchandise prizes carry no warranty other than that offered by manufacturers. Sponsor has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Other restrictions apply.

TO ENTER

Game begins February 18, 2011 at 12:01 a.m. Eastern Time (“ET”), and ends on March 17, 2011 at 11:59 p.m. ET (“Promotion Period”). Weekly Games correspond to the Dow Jones Industrial Average weekly trading periods. Entries for Weekly Games will be accepted beginning at 12:01 a.m. ET on the last trading day of the preceding calendar week (usually Friday) and ending at 11:59 p.m. ET on the day preceding the last trading day of the calendar week (usually Thursday).
The Game consists of two (2) steps:
- User Account Registration: To play the Game, you must first visit www.guesstheindex.com and create a User Account by completing a one-time registration form with the following required information: (i) name, (ii) address, (iii) telephone number, (iv) e-mail address, (v) date of birth, (vi) User Name, and (vii) password.
- Enter Your Guess(es): After you complete your initial User Account registration, you may play the Game at any time by logging into your User Account and entering your prediction (an “Entry”) for the value of that Week’s Dow Jones Industrial Average (symbol: DJIA) at the closing of the market. Guesses will not rollover to the following round. To qualify for each weekly prize you must submit a guess for that weekly round which begins at 12:01 a.m. ET on the last trading day for the stock market during the prior Week. The deadline for each Weekly Game is 11:59 p.m. ET on the day before the last trading day for the stock market that Week.[1] Your prediction must be stated down to two decimal points, for example 7342.17 or 9376.00. You may submit as many Entries as you like, so long as they all originate from a single User Account; however, each Entry supersedes your prior Entry and only the last Entry that you make prior to the stated deadline will be considered. Users must not enter a comma in any field that requires you to place your guess. All entries containing a comma will be discarded.
- Note: Limit one (1) User Account per person and per e-mail address during the Promotion Period. Once you have registered, you will not be required to register again for the Game during the Promotion Period. Entrants must include a valid e-mail address for the entrant when registering his or her User Account. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be deemed made by the “Authorized Account Holder” of the e-mail address used at time of entry. “Authorized Account Holder” is defined as the natural person, 18 or older, who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
To be eligible for any Weekly Game, all Entries must be received by Sponsor no later than 11:59 p.m. ET on the day prior to the closing of the Dow Jones Industrial Average. Neither proof of sending nor print-outs of screen shots are proof of receipt by Sponsor. Entrants who fail to provide the required information will not be eligible to win and will not be notified by Sponsor. Entries become the property of Sponsor and may not be returned or acknowledged.
As stated above, you are limited to one (1) User Account per person and per e-mail address during the Promotion Period. Any use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar entry methods or agents (including, but not limited to, contest-entry services) are prohibited and will void all entries submitted by that entrant. If Sponsor determines that an entrant has registered more than one (1) User Account or has utilized any prohibited method for submitting any Entry, all of that person’s Entries will be disqualified and his/her User Accounts may be suspended or terminated, at Sponsor’s discretion.
The information that you provide in connection with the Game may be used by Sponsor in accordance with its Privacy Policy, which is found at www.guesstheindex.com and which may be updated from time to time.

WINNER DETERMINATION

On Monday following each Weekly Game, or within a reasonable time thereafter Sponsor or its designee will determine which of the Entries was closest to the closing price for that Week’s Dow Jones Industrial Average (the “Closing Price”). The determining source of the Closing Price may be found at www.djiindexes.com listing of Dow Jones Industrial Average and reflected in the Dow Jones “ticker” that will be displayed on the Contest website. Subject to verification of eligibility, the person whose Entry is the closest to the Closing Price will be declared the winner of that Weekly Game.
In the event of a tie, the entrant whose final entry was received first during that weekly promotion will be declared the winner. Closing Price Information is received from Dow Jones and Sponsor is not responsible for the accuracy of such data.

WINNER NOTIFICATION

Sponsor will contact all potential winners in accordance with the information supplied to Sponsor in connection with their User Accounts. Entrants acknowledge that is it their sole responsibility to ensure that their contact information in their User Account is and remains valid and accurate at all times and that Sponsor will not be liable for any inability to notify potential winners or deliver prizes in the event that potential winner fails to provide and maintain accurate and valid contact information in his/her User Account.
Potential winners will be asked to provide Sponsor with valid identification and execute an affidavit of eligibility and, where legal, a publicity release. Acceptable identification includes a valid driver’s license or other valid picture ID showing name, address and age. Faxes will not be accepted. Potential winners may also be required to sign other legal documents, including tax forms and a release supplied by Sponsor that, among other disclaimers, releases Sponsor, the Weekly Prize Supplier, and a range of subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons from any and all liability related to this Game and the receipt and use of any prize. Upon verification of eligibility, the names of winners may be posted on the Sponsor’s website at www.guesstheindex.com.
In the event that any potential winner (a) cannot be contacted directly by Sponsor within two (2) days from initial attempted notification, (b) fails to satisfy any eligibility or verification requirement herein, (c) declines to accept the prize, (d) or is otherwise determined to be ineligible, Sponsor in its discretion may disqualify that individual and the person with the next highest guess will be declared the alternate winner as soon as reasonably practicable after initial winner is determined to be ineligible. Alternate winners are subject to all eligibility requirements and restrictions of these Official Rules.

PUBLICITY RELEASE

By accepting a prize, winners agree to award Sponsor the right to publicize their names, photographs (including the use and appearance of winner's photograph on Sponsor’s web page), likenesses, biographical information, e-mail address, voices and details of winning for purposes of this and future promotions without further compensation, except where prohibited.

LIMITATION OF LIABILITY/DISCLAIMER OF LIABILITY

Entrants agree that Inside Wall Street, Weekly Prize Suppliers, and a range of subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons (a) are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any lost, misdirected, postage-due, illegible, mutilated or damaged registration forms, User Accounts or Entries, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for registration forms or Entries that for any reason are not received by Sponsor by the deadlines stated above; (b) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this Game or downloading of any software or materials; (c) are not responsible for delayed, damaged, inaccurate, or incomplete Closing Numbers received by Sponsor via its Dow Jones ticker or from the Dow Jones website; (c) are released from any and all liability related to this Game and the receipt and use of any prize; and (d) will not be responsible for the inability to determine winners because of postal failure, equipment failure, or data storage failure.

MISCELLANEOUS

All federal, state and local laws apply. Sponsor shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding User Account registration, Entries, deadlines, determination of winners, restrictions on prizes, and eligibility — and all of its decisions are final. By entering, entrants agree to these Official Rules.
Sponsor reserves the right to cancel, terminate or suspend this Game or any part of this Game should any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Game as determined by Sponsor in its sole discretion, at which time, Sponsor will select the winner based in accordance with the prior stated criteria from among the non-suspect Entries received at the time of the Game cancellation, termination or suspension.
Sponsor reserves the right to prohibit any entrant from participating in the Game if, at its sole discretion, Sponsor finds such entrant to be tampering with the registration or entry process or the operation of the Game, or if such entrant repeatedly shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner Sponsor determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant, Sponsor or any Weekly Prize Supplier; or (c) in any other disruptive manner. Any person attempting to defraud or tamper with this Game in any way will be ineligible for prizes or further participation in this Game and may be prosecuted to the full extent of the law. Tampering includes, including limitation, entering through more than one (1) User Account or using any automated device or other method of entry prohibited by these Official Rules or the Contest website. Any failure by the Sponsor to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.
Sponsor reserves the right to correct typographical or clerical errors in any Game-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes in accordance with the prior stated criteria from among all legitimate, un-awarded, eligible prize claims.

DISPUTES

By entering the Game, entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Game, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Game, but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants, Sponsor and any Weekly Prize Suppliers in connection with the Game, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Florida. Any legal proceedings arising out of this Game or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of Florida, County of Seminole and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
